(KMOV) – Two dozen family members in were getting ready to take a photo when they deck they were on collapsed. And it was all caught on camera.

The incident happened just before Christmas in New Albany, Ind.

No one was killed, but three people are still not walking. Others were more fortunate. A 13-month-old baby escaped unhurt thanks to her dad who clutched her in his arms as they fell. Another man caught a sliding deck bench with one arm to keep it from crushing people below.

“Some people called this a freak accident. You know a meteorite hitting your house would be a freak accident. This was going to fall one day,” said victim Jeremy Wilk.

Family members are now suing Schuler Homes, the deck builder, as well as the homeowner’s association that runs the club-house where it happened.

A spokesman with Schuler Homes said the law shields them from liability because the deck is more than 10 years old.
