02:52 PM CST on Saturday, December 29, 2007
PAGEDALE, Mo. (AP/KMOV) -- Police say a pizza delivery man who shot and killed a robber did have a concealed - carry permit.
Thursday evening two men tried to rob the Domino's pizza man after they called for a pizza to be delivered in Pagedale.
The driver opened fire killing Brian Smith, 19 of Ferguson.
The second suspect ran off but was arrested Friday.
The driver has an out-of-state permit, but one officer says it should be valid in Missouri.
Neighbors say they heard at least five shots.
A source says Smith was carrying a cell phone, and the last call on his phone was reportedly made to the Domino's pizza.
The source also says Smith was carrying a toy gun, but the second suspect had a real gun and fired at least one shot.
