City Counselor's Office: Gardner can't be fair during investigation into Greitens investigator

ST. LOUIS, Mo. (KMOV.com) -

The City Counselor’s Office argued Wednesday that Circuit Attorney Kim Gardner cannot be fair and impartial during an investigation into an employee she hired to work on the case against former Missouri Governor Eric Greitens.

Gardner hired a private investigator, William Tisaby, for the case. Last month, Greitens’ defense team filed a police report claiming that Tisaby committed perjury.

Wednesday, The City Counselor’s Office, which represents the police, said officers were investigating the case, just as they would any other.

They told Judge Michael Mullen they want to seek investigative subpoenas, but believe that Gardner and the Circuit Attorney’s Office has a conflict of interest. They asked Mullen to appoint a special prosecutor in the case.

Gardner’s office has hired attorney Joseph Bednar to represent them in the case. Bednar argued that the police were “prosecutor shopping” and said that a motion for a special prosecutor was premature.

The Circuit Attorney's Office later released the following statement:

The Circuit Attorney’s Office has hired Joe Bednar of Spencer Fane as outside counsel to help manage the request by the City Counselor for a Special Prosecutor related to one of our investigators in the Greitens’ matter. Given the nature of the allegations and the position of the City Counselors, we have rightly so, sought an outside independent legal analysis to ensure the decisions we make are in the best interest of the public.

We believe the request for a Special Prosecutor for the inquiry into allegations against William Tisaby are without merit.  We strongly believe this investigation is nothing more than a political maneuver, based on pre-trial gamesmanship by defense counsel, by those who objected to us holding a public official accountable. To date, we have not been asked for one document or one piece of information related to this matter. So, we question the motivation of this entire motion.

We will not allow the same police department, that refused to assist us with the Greitens’ investigation, to be used as a pawn to retaliate through the guise of an unsupervised and unauthorized investigation. 

The office has signed a contract with Mr. Bednar for $10,000.
