'That's pre-meditated murder;' family of man shot by Papa John's employee speaks

(KMOV.com) - The family of a man shot and killed by a Papa John’s employee in South City said they can’t understand why the employee didn’t wait for police instead of pulling the trigger.

The family of Ollice Upchurch said they still trying to make sense of what happened. Police said Upchurch threw a concrete chunk into the door of a Papa John’s location in South City. The employee, who said he feared for his life, left the store, came back and shot Upchurch.

“I’m still just so confused and hurt by this situation,” said Upchurch’s cousin, Andrea Vincent. “You had time to think about what you were going to do, anything of that sort is premeditated murder.”

Vincent says she understands the employee might have acted out of fear because the store had been robbed days before but said his actions did irreversible damage.

“This person had time to think about what he wanted to do and due to that, my cousin is no longer here,” said Vincent.

Vincent says her cousin worked at an area YMCA and was a father of three.

“We should think twice about every decision that we make,” said Vincent.

Vincent added that the family is still trying to find peace.

Papa John’s said the employee has been placed on leave while the investigating is ongoing.

The incident that occurred at one of our locations in St. Louis is a tragic event.  The safety of our team members and customers is a top priority at Papa John’s. Company policy prohibits employees from utilizing firearms in the performance of their duties. We are fully cooperating with the police department’s investigation.
