ST. LOUIS, Mo. (KMOV.com) -

Voters in the 78th District of St. Louis are heading back to the polls for the second time in little more than a month.

Circuit Court Judge Rex M. Burleson called for today's election do-over and this week, a Missouri Court of Appeals upheld the judge's ruling.

Original election results showed incumbent State Representative Penny Hubbard beating Bruce Franks Jr. during Missouri's primary voting back on Aug. 2. However, questions concerning the absentee ballots landed the candidates in court.

After two wins in the courtroom, Franks has another opportunity to win a ticket to the state capital in Jefferson City.

Franks believes the voter turnout this time around is going to be better than people expect.

News 4 reached out to Hubbard's office multiple times for an interview. Her office never replied.

The polls open at 6:00 a.m.
