Mother of boy who was served restraining order at school is facing own legal problems

The mother of a Hillsboro third grader with an order of protection against him is facing serious legal issues of her own.

News 4 has learned 37-year-old Danniel Whitehead was arrested twice recently and has multiple orders of protection against her.

News 4 has been tracking the story of the unusual case of an ex-parte order of protection being filed against 8-year-old Peyton Whitehead. On September 7 he was removed from school by Jefferson County Sheriff's Department deputies and was told he can't go back until after the order of protection is lifted.

In court documents Peyton Whitehead is accused of telling another boy in the neighborhood "he was going to slice his head off" and telling a girl "he was going to murder her with a knife and throw her off a cliff."

Over the second weekend of September deputies were called to the Whitehead's neighborhood three times and on September 10 made an arrest. 

"There was an arrest made with the 37-year-old white female and she was transported to booking," said Lieutenant Gary Higginbotham of the Jefferson County Sheriff's Department.

He said the suspect was booked on suspicion of assault, domestic violence, trespassing and failure to comply with a court order and then released pending application of warrants. 

The sheriff's department is not releasing the name of the suspect since warrants haven't been returned. But News 4 was able to confirm that it was Danniel Whitehead in the suspect's mugshot. Deputies were also called back to the same neighborhood on September 11 on a report of disturbing the peace and arrested the same woman for an outstanding municipal warrant out of Pevely.

Also, three orders of protection were filed against Whitehead over the weekend bring the total number of protection orders against her to four.

Previously, an order of protection had been filed against Danniel Whitehead by the mother in the family that filed an ex-parte against 8-year-old Peyton. In the court documents the boy's mother is accused of threatening to kill her neighbor and telling the woman to "move or die."

The recent orders of protection were filed by a neighbor who claimed Whitehead threatened to harm her and by another neighbor who alleged Whitehead attacked her on September 10. In court documents the woman claims Whitehead was "trying to rip my cheek off" and "banged my head against the truck window a few times."

A fourth order of protection was filed by Danniel's husband, Ronald Whitehead. In court documents he claimed "she has been violent with my son and me." Mr. Whitehead goes on to allege she "threatened to hit me with a lamp over my head" and to "leave with Peyton."

In the court order, Mr. Whitehead is given custody of Peyton and Mrs. Whitehead is not allowed to live at the family's home and must participate in a court-approved counseling program for batterers and/or substance abuse.
