Man injured after falling through manhole; MSD says it's not at fault

ST. LOUIS (KMOV.com) - A St. Louis man is recovering from injuries he sustained after falling through a manhole on his walk to work.

Michael Brand, 60, walks along Stratford Avenue every day, but on March 16 his walk wasn’t so smooth.

“When I took a right step all of a sudden I just went down,” said Brand. “Where my foot stepped, it [manhole cover] broke and that caused my foot to go down and then it flipped up.”

Brand fell chest deep into the manhole and was able to catch himself before falling all the way through. He said he’s been out of work since the incident. Brand said he filed a claim against the Metropolitan Sewer District, MSD, but the company told him they are not responsible for his injuries.

Brand received a letter from MSD explaining a crew went to the site and found a broken inlet cover, and replaced the cover. A second letter was sent from Corporate Claims Management Inc., which handles MSD’s liability claims. The company explained MSD had no prior notice of the condition of the manhole, therefore are unable to accept responsibility for injuries.

But that explanation doesn’t cut it for Brand.

“They do have some liability for this because it wasn't my fault, plain and simple,” said Brand.

News 4 contacted MSD and during a phone conversation a company spokesman reiterated what the letter explained. Brand said he is seeking legal representation to take his case to court.
