NORTH COUNTY, Mo. (KMOV.com) – A St. Louis woman was charged Friday by a grand jury following an August, 2015 accident that killed an off-duty Bellefontaine Neighbors police sergeant.

Court documents allege Latonia Waites, 33, was distracted by her cell phone when she struck Peggy Vassallo with her car. Waites is charged with 2nd degree involuntary manslaughter.

Just before 8 a.m., on August 24, 2015, Vassallo, 53, who was an off-duty sergeant dressed in full uniform and heading to work, was involved in a minor accident in the area of Highway 67 and Old Jamestown Road. When Vassallo exited her personal vehicle to talk to the other driver, she was struck by another vehicle, allegedly driven by Waites.

Vassallo was taken to the hospital where she later died.

Vassallo was the DARE officer at GIbson Elementary in the Riverview Gardens School District.

The St. Louis County Police Department's Bureau of Crimes Against Persons unit and the department's accident reconstruction team are conducting the investigation.
