A former O’Fallon, Mo. police detective was sentenced to 120 days in prison for stealing drugs that were considered evidence.

Luke Smyka, 37, was sentenced to 120 days in prison Tuesday, but he could be locked away for 10 years if he does not complete 120 days of drug rehab in prison and five years of probation.

Smyka stole hydrocodone and methadone pills that were locked away as evidence. Smyka removed the medication from the evidence packaging and then replaced the stolen pills with different medication.

The thefts happened in 2013 and 2014. Court documents indicate Smyka told police he was addicted to painkillers.
