Federal lawsuit seeks damages for student sexually assaulted at Fox High School

ST. LOUIS, Mo. (KMOV.com) - A federal lawsuit was filed by the law firm of Chackes, Carlson and Gorovsky on behalf of a student who was sexually assaulted by one of her teachers while she was a student in the Fox C-6 School District in 2011.

In the lawsuit, the victim's lawyers argue Fox High School faculty harassed her after she reported being abused by teacher Eugene Milzark.

"This student obviously should never have been abused by Milzark in the first place, but to make matters worse, the school made this student's life miserable after she reported the abuse. This needs to stop," said Attorney Nicole Gorovsky in a press release. "Minors need to be free to report sexual abuse without fear of retaliation."

Milzark was convicted on the sexually assault charges and was placed on probation.

According to the release, the victim is filing the lawsuit because she wants to "let the school district know that this shouldn't happen to kids. No one else should have to go through this."

The lawsuit did not disclose a dollar amount the victim seeks in damages.

In response to the lawsuit, the Fox School District Spokesman said there will be no comment on the case other than that the case will be covered under the district's liability insurance.

The insurance company is expected to mount a defense in the case.

The victim is now in her twenties.
