(KMOV)-- A newborn baby boy suffocates in Lake St. Louis and prosecutors say his mother was passed out drunk when it happened.

Alyssa Rae Potter is charged with endangering the welfare of a child.

Police said the baby was in the bed with Potter when he accidentally suffocated.

Officers said 4 hours after potter called 911 her blood alcohol level was .20, more than twice the legal limit of .08.

Her lawyer said the felony charge is outrageous and there isn't evidence to prove she was responsible for the baby's death.
