EDWARDSVILLE, Ill. (AP) -- The estate of a 7-year-old girl who died last year in the collapse of an old industrial tank located near an Edwardsville park is suing the city.
Ryan Crow seeks at least $50,000 on each of 33 counts in the lawsuit filed in Madison County Circuit Court for the 2009 death of Macie Crow.
Authorities say Macie Crow died instantly in the accident, and her 9-year-old brother was treated at a hospital.
Because of the danger it presented, the tank was demolished after the accident.
The lawsuit claims the city allowed the decades-old tank to deteriorate, knowing it posed a danger to children.
City attorney Jeff Berkbigler told The Associated Press on Wednesday the city hasn't been served with the complaint and he couldn't immediately comment. He said the city anticipated making a formal statement soon.
