(KMOV)-- A mother has been charged with murder in the September 2010 death of her 4-year-old son.
Patricia Cage was originally charged with Endangering the Life of a Child for allegedly failing to seek medical attention for her son, Jeremiah Bradford, who died after being beaten by Cage's boyfriend Sean Starwalt. Starwalt is awaiting trial on First Degree Murder charges.
Cage is now charged with First Degree Murder (Accountability) and Endangering the Life of a Child.
Authorities say new information that developed in the case against Cage led to a review of a review of the applicable case law.
Assistant State's Attorneys Ali Summers and Christopher Hoell presented the new evidence before the Grand Jury on the theory that Cage’s failure to protect Jeremiah from abuse and her refusal to seek medical attention that night amounts to First Degree Murder by Accountability.
Cage and Starwalt both remain in custody at the Madison County Jail in Edwardsville.
Cage will go to trial following Starwalt who is set for trial in late June 2011 with Judge James Hackett.
The maximum penalty for Murder is 20-60 years in prison; she is facing 2-10 years on the Endangering charge.
