ST. LOUIS (AP) -- An eastern Missouri man who filed a wrongful death lawsuit against his ex-wife for the death of their infant son has been awarded $300,000 in damages.
The St. Louis Post-Dispatch reports (http://bit.ly/IvRDG0 ) a St. Charles County jury returned the verdict Thursday in favor of Joseph Potter against 43-year-old Alyssa Kley of Lake Saint Louis.
The two were still married when their 6-week-old son, Wyatt Potter, died in November 2009 of accidental suffocation. A medical examiner estimated the baby had been face-down on a bed for at least an hour after he died.
Potter argued Kley negligently caused the death because she was drunk when the baby died. Kley told investigators she had fallen asleep after drinking three or four glasses of wine.
A grand jury declined to indict Kley on a criminal charge.
