FENTON, Missouri (KMOV) – Police have arrested a man they say was shot in the leg during an alleged burglary on Tuesday.

Richard Bates, 24, was charged with first-degree burglary, theft of a firearm and unlawful use of a firearm.

Police said officers responded to a home on Creek Drive around 2 a.m. after the victim, 59, awoke to find Bates standing in a bedroom holding a handgun.

Police said the victim pulled out a handgun and fired two shots at Bates, hitting him in the leg.

Bates then fled the scene.

Police said Bates went to St. Clare Hospital a short time later and was treated and released.

Bates has a previous conviction for burglary and was living six doors away from the victim.

He was taken into custody and transported to Jefferson County Jail. His bond was set at $75,000.
