(KMOV) – A 12 and a 13-year-old who were facing sodomy charges after allegedly raping a 10-year-old girl six months ago, were set free on Tuesday.
The father of the 10-year-old rape victim says the girl was raped in the woods behind an apartment complex and just learned one of the alleged attackers is back in the neighborhood.
A letter from the family court attorney says the matter was set for trial. That changed when the father and the court came to an agreement, saying it would be in best interest of the young girl to resolve the case without having her testify.
The father had agreed, as long as the boys agreed to go to counseling. One of the boys did go to counseling, the other did not.
The family attorney, Bryan Seltzer, decided to drop the case and closed the letter by saying call the police if there are any problems with the boy when he returns to the neighborhood.
A court spokesperson said they could not comment on the case, but suggested that the father give them another call.
