ST. CHARLES, Mo. (KMOV) – A 54-year-old man accused of exposing himself to people at a St. Charles pool in 2011 has been found not guilty because he was ruled to have a mental disease or defect.

Gerard Sudheimer was charged with second-degree sexual misconduct after he allegedly exposed himself to patrons at Wapelhorst Swimming Pool in the 1900 block of Muegge Rd. on June 29, 2011.

Police responded to the park that day after park rangers said Sudheimer pulled down his swimming trunks and exposed his genitals and buttocks to several people at the pool.

Sudheimer will be released from custody after authorities say he was deemed not guilty because of a mental disease. Exact details into the decision were not immediately known.

News 4’s Emily Rau is talking to the prosecuting attorney and will have more information on the court’s decision coming up at News 4 at 5 and 6.
