(KMOV) -- A local business owner is headed to court after claiming he paid for trash service that was never performed.
The city of Alton is being accused of charging businesses for trash pickup even though the service was never performed for years.
The owner of Commando’s Surplus is suing the city after paying them for trash pickup for about six years but the city never collected the trash.
“I believe they were doing the same thing to about 300 businesses,” said Attorney Ed Moorman, representing the owner of the surplus store.
The Class Action Law Suit asks that the money be refunded to all of the businesses and Attorney Moorman said he may add some other monetary requests to this suit.
But the mayor of Alton disputes the claim that 300 businesses have been paying and not getting their trash picked up.
He said he wants the money refunded to those affected but he does not think it was widespread.
The mayor promised that the city comptroller will be checking all the bills to determine if any businesses were overbilled.
