Potter told police that she was intoxicated from drinking wine before falling asleep in bed with her 6-week-old son. The baby accidentally suffocated; when she woke up, she noticed that he was not breathing.
Officers said that Potter's blood alcohol level was .20, more than twice the legal limit of .08.
A grand jury decided there was insufficient evidence for an indictment.
