Mental evaluation sought for teen suspect in death

SPRINGFIELD, Mo. (AP) -- A Springfield man charged in the fatal shooting of a high school student is asking for a mental evaluation.

An attorney for 19-year-old James C. Duke III says the request does not mean he will use an insanity defense in the case. Dee Wampler says he wants to learn Duke's mental state when he allegedly shot 17-year-old Kody Ray.

Duke is charged with first-degree murder in the March 22 death of Ray, who was killed on his front porch.

The Springfield News-Leader reports that Duke admitted the shooting in a videotaped interview with police. He says he thought Ray was going to pull a gun.

Another teen, Jordan Martin, also is charged in Ray's death.

Duke's trial is scheduled to begin Oct. 31. Martin's trial is scheduled for January.
