ST. CHARLES, Mo. (KMOV.com Staff) -- The State Supreme Court overturned the conviction in the alleged assault of a suspect by a St. Charles County deputy.

Deputy Christopher Hunt was charged with assault and burglary after kicking down the door of a home and hitting a suspect repeatedly during a 2009 meth bust.

The Missouri Supreme Court ruled that Hunt did have the authority to hit the suspect.

Hunt could now stand trial to decide if excessive force was used.
