Rolla: Man charged with assaulting 4-month-old baby

Wednesday, November 25, 2009 – Rolla Man Arrested For 2nd Degree Assault on a 4-month Old Baby.


On November 16, 2009 Deputies from the Phelps County Sheriff’s Department responded to the Phelps County Medical Center for a reported Child Abuse.  Upon arrival, they met with the Mother of a 4-month old baby boy who was lethargic and non-responsive.  The Mother reportedly left the child in the care of her live-in boyfriend while she went shopping.  When she returned, she found the child in this condition and notified medical authorities.  The baby was treated and then transferred to the Children’s Hospital in St. Louis, where he is presently in stable condition.


Sammy Joe Mayberry, age 25, who resides with his parents on South Cedar Street in Rolla was arrested just after 10:00 AM this morning without incident.  He is being held in the Phelps County Jail on one count of Assault in the 2nd degree with a $25,000.00 bond.


According to the probable cause statement, Doctors in St Louis determined the baby suffered “a subdural hematoma cause by acceleration-deceleration dynamic loading (shaking).”  During interviews Mayberry admitted to holding the baby “up in the air not supporting {his} head moving him side to side.”  Mayberry also told Detectives he didn’t know his own strength and may have shaken him to hard


The charge for which Mr. Mayberry has been arrested on are merely accusations and are not evidence of guilt.  Evidence in support of the charge must be presented before a court of competent jurisdiction whose duty is to determine guilt or innocence.
