(KMOV) -- Prosceutors say they will not file charges against an East St. Louis nightclub owner who shot and killed a would-be thief Monday morning.
Travis Heard, 35, of Washington Park, Illinois, was killed in this incident.
According to police, Heard did not have a weapon.
Police interviewed the club owner at the police station.
The shooting happened before 5:00 a.m. outside the club, Colony 2, what a police officer described as a "swingers" club.
Illinois State Police are assisting East St. Louis Police.
This is the first homicide investigation for East St. Louis Police since 19 officers were laid off on Sunday for budgetary reasons.
Negotiations between the police union and the city are expected to pick up again Tuesday. Police would not agree to one-day a week furloughs, but they may have decided a pay cut is better than no job at all.
