(KMOV.com) -- James Holmes’ lawyers were not ready to enter a plea Tuesday. The judge took matters into his own hands by entering a not guilty plea on Holmes’ behalf.

Holmes’ lawyers argued they needed more time to enter a plea. The judge denied the request, but he did leave the door open for the defense to change the plea to not guilty by reason of insanity.

Victim’s family members said they are happy to see the case move forward.

“I’m glad that he forced him into and made a decision for him,” said Theresa Hoover, mother of one of the victims, “Because we don’t need to keep continuing this.”

The 25-year-old faces 166 felony counts for the July 2012 attack that killed 12 people and injured 70 others at a Colo. movie theater.
