(KMOV.com) – News 4 has learned a man who broke into a woman's Franklin County home in Feb. and terrorized her with a gun will not serve prison time.

Michael Murphy, 39, was sentenced to five months probation after accepting a plea deal for a Feb. 18 robbery.

Authorities said Murphy broke into a woman’s home in the 400 block of N. Virginia Mines Rd. and held a gun to her head and demanded money.

The victim told police he pulled the trigger many times, but the gun did not fire. Authorities said Murphy then took cash and fled.

News 4 tracked down Franklin County Prosecuting Attorney Bob Parks, but he said he could not comment because the case is ongoing. 

The victim, Ann Missey, told News 4 she was outraged by the plea deal. 

“He obviously didn't finish the job so he's going to come back," Missey said. From what I've seen in his eyes he wanted me dead,” 

Murphy is still sitting in jail on two charges of violating his probation.
