(KMOV) -- St. Clair County adopted a tougher drug testing policy and will include certain employees and elected officials in random testing; however those officials have the option of declining.
The county had to include language in the new policy that would give elected officials the option to turn down the testing, because federal courts have ruled elected officials cannot be required to be tested, according to St. Clair County State’s Attorney Brendan Kelly. The policy sites Chandler v. Miller.
Kelly says all county elected officials have indicated they would agree to a random drug test.
New hires will also be tested in St. Clair County. Along with officials elected by the voters, some law enforcement, those who operate heavy machinery, and those who have access to controlled substances will be tested randomly.
“We crafted the strongest policy we could,” said St. Clair County Board Chairman Mark Kern.
On Monday night, St. Clair County approved an annual contract with Midwest Occupational Medicine who will take care of the testing and the record keeping.
