Prosecutors on Tuesday argued that the psychologist they would like to examine 30-year-old Terry Sadlacek has refused if the session is videotaped. Sedlacek is accused of shooting the Rev. Fred Winters of First Baptist Church in Maryville to death three years ago as Winters gave a sermon. Madison County Circuit Judge Richard Tognarelli has declared Sedlacek mentally unfit for trial.
But in May last year, the judge ordered Sedlacek to undergo new psychiatric testing to assess his competency. Sedlacek's attorney, John Rekowski, doesn't object to another examination. But Rekowski wants the examination videotaped as evidence.
The judge is to rule in about a week.
