Judge denies motion to dismiss criminal charges in case against Illinois trooper

(KMOV) -- A judge in Belleville made a decision in the case of an Illinois State Trooper charged with killing two sisters on Thursday.

The lawyer for Matt Mitchell wanted reckless homicide charges dismissed.

Judge Jan Fiss denied the motion to dismiss the criminal charges against Mitchell.

In 2007 Mitchell's car wrecked with Jessica and Kelli Uhl killing them. Mitchell's attorney says his client was justified when he was driving 126 miles an hour just moments before the crash.

Prosecutors say Mitchell was sending emails and talking on his phone.
