A Foristell man faces his fifth driving while intoxicated charge after he allegedly could not complete a sobriety test because he could not stand up.
Sean Herod, 32, was charged with DWI as a chronic offender.
According to police, they tried to carry out a sobriety test after Herod was pulled over for driving wildly on Highway 94 near Westwood Dr.
But the deputy on scene said the test could not be completed because Herod could not stand up.
He also refused a Breathalyzer test, so officials obtained a search warrant for a blood sample.
The incident happened nine days after Herod finished probation for two DWI convictions in 2006.
Herod was also convicted of DWI in 2000 and 2004.
