(KMOV) – The ACLU is suing St. Louis County Police Department for refusing to turn over documents claiming a lieutenant was racially profiling while on duty.

The department fired Lieutenant Patrick Hayes over the accusation that he was ordering officers to target African American drivers in a South County area.

One of his officers wrote that Hayes told them to pull over African Americans around the South County mall. The ACLU said the department is violating public records by refusing to release the letter.

“If it’s true, the ACLU and public are entitled to know that. If it’s not true, the officers entitled to be vindicated.” Jeffrey Mittman of the Eastern Missouri ACLU said.

As of Tuesday evening, the department is refusing to release any of its records.
