(KMOV) – A Missouri judge has ordered a new trial for a St. Peters mom convicted of child abuse.

Gina Grzeskowiak, 38, was found guilty in March and faces up to 15 years in prison. Her attorney filed a motion before sentencing asking for a new trial because a child recanted the story of abuse.

A St. Charles County Circuit Court judge ruled her conviction be thrown out. Prosecutor Tim Olohmar says he will ask the judge to reconsider the ruling.

Grzeskowiak was initially charged in July, 2013 for allegedly punching her 9-year-old daughter and throwing a can of infant formula at her, which caused a gash on the girl's forehead.
