(KMOV.com) - A new lawsuit in the Metro East claims Papa John’s Pizza stores were collecting an illegal sales tax from Illinois customers.

The class action suit filed in Madison County, claims Papa Johns charged sales tax on their delivery fee, which is not allowed under state law if customers have the option of picking up the pizza themselves.

Court documents said in one instance, the bill from a Papa John’s delivery showed a 16 cents sales tax on a $2.39 charge for home delivery.

The suit also claims Papa Johns was charging the delivery charge sales tax at all of its 122 stores in Illinois.

Papa Johns did not respond to a request for a comment.
