(KMOV)- A victim in last week's deadly crash on Interstate 64/40 is suing the trucker and trucking firm involved in the accident.
Lawyers for 49-year-old David Jayne say he suffered multiple life threatening injuries.
Prosecutors are still deciding whether to file criminal charges against the trucker Jeffrey Knight.
He is accused of driving his tractor trailer into stopped traffic.
Three people died in the crash and 16 were injured.
My prayer goes out to everyone that was in the deadly accidentally or driving on the highway at that time. I was driving on highway 40 that day when the traffic suddenly came to a stop. Car wasn't moving. People began to park their car and get out to see what happen. I can't yet began to say what we seen on the highway. We were stook on the highway for about 2 and half hour before they direct traffic to back up and turn away. I was the third car in the left hand lane. I am Blessed. The trucker will live with these for the rest of his life as a nightmare that will never go about. I have my own beliefs about if he should be charged are not. I speed on highway 40 because I be trying to avoid traffic and get home. Since that accident I have slowed down alot. I called home that day to let my mother know that I was okay and Thank God my phone wasn't dead because my mother would have went crazy knowing I travel that highway and she couldn't get in contact with me. I alway said truck driver think that have VIP and run other drivers off the road. I speed by truckers because I don't want them to change lines and don't see me but i refuse to jump in front of them. I believe his should be charged for being careless and I am sure he have taken responsiblity for his action. This will be one deadly accident I will not forget. Good Bless!
Accidents are part of life and its weird that we all havent accepted that. So many actually think banning something will avoid accidents. People are always going to make mistakes and all the laws and bans in the world wont make a human a perfect being. As for the victims of the accident, my heart goes out to them.
We first would like the families to know our thoughts and prayers are with them.I'm sure a lot of us know,we've all had close calls on the hiway.That split second has changed lives forever.I also saw on the pictures how our firefighters and police helped save the lives of a lot of people.thank you!the things they see and do must take it's toll,pray for the truck driver,his hell has just begun.I agree with the truck driver about the non use of the left lanes for trucks.the hiways on major interstates will always be hectic and busy.I have seen soooo many cars pass the trucks up to cut in from of them to get to their exit.Please MODOT!!!!Trucks are never going away.We get everything deliverd from them.Think about it,Please!Change our hiways
While this tragic accident was not intentional on the part of the truck driver, I do believe he should have his commercial license revoked. My heart goes out to all the victims and the driver. This would be hard to live with.
My heart goes out to the families of the victims that die in this tragic accident, and those that were injured, I'm praying they will have a healthy recovery. I feel sorry for the trucker that caused this disaster, I can only imagine what state of mind he must be in knowing the lives he destroyed, and what he faces ahead, Don't you think that is punishment enough? Accidents are not only caused by truckers, I deal with idiots every morning on east bound 70, I'm driving the speed limit, while most drivers wants to do 75-85, thats an accident waiting to happen.
Cell phones should be illegal to use while operating a motor vehicle. I believe they are a huge distraction when you are driving. How many more innocent people will die before we admit that cell phones and driving do not mix.
Ive been drivin a truck for ten years, for those who think truckers the only wreckless drivers out on the road you better wake up and smell the coffee everybody is wreckless one time or another on the highways young or old in a car or truck or on a motorcycle. im sure the ones who have commented on here arent the perfect drivers, i do agree the truckdriver is at fault for paying more attention a stupid cell phone then the situation in front of him, cell phone use in a car and a truck should be illegal and his speed was way too fast for driving on an interstate in the city limits,but like him im sure there were several cars speeding through there too, lowering the trucks speed limit wont help with accidents itll only make it worse. ive been through states with the truck speeds lower than cars ive seen more accidents in those states, trucks should have their own lanes but that can also create problems as far as traffic jams the lane restriction on 70 is the dumbest thing i ever seen cause you have cars speeding up the left lane all the way to the exit then cuttin across two lanes cause their too much in a hurry to get home to wait in traffic like other peple do. im surprise more people arent getting in accidents there. i can promise you the state troopers and other officers do their jobs, theres only so many of them to keep an eye on all of us, maybe the next time when you are pulled over tell them you want a ticket instead of warning, but that wont happen cause youll probably beg for a warning so you dont have to pay a fine.im not a perfect driver ive broken a few laws myself while in my rig and in my car but i can admit that unlike those who cant,especially the ones with their own kids in their cars speeding through traffic.theres one way too slow trucks down pay higher prices for goods at the stores that way drivers and the companies they drive for can make money and be safer but then that wont work will it cause it would cost you too much money
Okay, I was ready to put this truck driver in the clink for life, when I first listened to the first Dash Cam in the patrol car. My mind was changed. While I still think he was guilty of inattention with his cell phone, while driving a huge big rig, he at least demonstrated human decency in that encounter with the officer. You can hear him proclaim "I'm the one who caused this" and he has genuine concern for the victim trapped in the first car - you can hear it in his voice. No defensive, arrogant posturing, no arguing fault. This changed my opinion of him. He should do some "shock time" (as should probably many Americans) so he learns to NEVER be INATTENTIVE again while driving a rig. But I don't think he meant harm.
Now, listening to the patrol officers is another story. See even one officer or hear anything by the officers that indicates they care at all about what happened? In fact, the driver pleads for help for the seriously injured victim - the cop refers him to "another officer". What chumps. Maybe it IS the patrol's fault for not giving a darn and allowing these truckers to drive that way. Pulling over them big rigs would just be far too much trouble, and would cut into donut time or time to act tough in front of kids for playing loud stereos, or something equally pointless. These tapes sure are revealing about how things really are, that's for sure!
I just pray the Lord calms all involved here and gives them peace. This was very tragic, and I cannot imagine what the truck driver is experiencing. His record was clear, and he has to live with this mistake the rest of his life. I believe that to be a consequence that will prey on him forever.... is that not enough? It would be one thing if the man continually took to the road with multiple strikes against his record, or under the influence of something, but he wasn't. And you cannot categorize him with the ones you have seen disrupting the road, and hold him guilty because you have seen other driver's abuse. We do not even have the total report yet. Be careful, because life has taught me that as soon as you hang someone you will usually find it in your own back yard. Praying for all families involved - God Bless.
They call them "accidents" for a reason.....not "on purposes". This is tragic, for ALL that were involved, but the truck driver's personal hell has only just begun.
There is more than enough blame to go around. First the driver in this case carries the most blame. Second the trucking companies must also be held accountable. Demands for on-time deliveries increase while companies do not allow enough time for unforseen events. Drivers must constantly make up time that has been lost due to road construction, traffic jams etc. Third the highway patrol in each state must carry some responsbility, after all how many times have you been traveling at or more than the speed limit only to be passed by an 18 wheeler. But how many times do you see these trucks pulled over by state or local police? It's as if law enforcement turns a blind eye to speeding trucks.
I feel bad for the all the people involved in the accident even the truck driver, he has to live with this the rest of his life. And another thing all truck driver are not to blame, I've been on the highway many times and I see cars cutting in front of 18 wheelers and then put their brakes on, those trucks can't stop that quick. I think people should leave the truckers alone. Truckers are good people, one time my husband got really sick when he was driving and pulled over to the side of the road and passed when he got out of the car, well I couldn't lift him and the only people that pulled over to help me was the truck drivers so I think people need to lay off the truckers cause I don't know what I would of done with out them
To those that say that cellphones are not worse distractions than anything else, you have no idea what you are talking about. When's the last time you saw someone do something completely ignorant and they were touching their radio or taking a drink of a soda? I bet you can't name one. On the other hand I can name atleast 5 times a day I see drivers who are completely oblivious due to cell phone use.
If in fact this man was using a phone and just plowed those people over, I hope he has to relive it everyday of his life, hopefully while he's in jail.
Its not the blame of the highway, the truck or even the cellphone. Its entirely on him for being so careless.
To start, I knew the one person that was killed, and I just want to say how sorry I am for them. To the people that say do not blame the truckers, GET A LIFE. Compare this to guns, guns do not kill people, people kill people. The person behind the gun or truck for this matter is responsible for there actions. This guy apparently was not very responsible for his. Back to not blaming the truckers, that is bull. I cannot count the number of times that I have been cut off by truckers. I just love the bumper sticker on the back of semi's that say LIGHTS ON FOR YOUR SAFETY. Who cares about your lights. I do not want you tailgating me. Truckers need to be in better control of their semi.
This was an unfortunate accident that could have been prevented by big trucks not going so fast. It is cell phones to blame, there are many other things people are preoccupied by other than cell phones such as changing radio station, drinking a beverage, getting your sunglasses out and putting them on, reading a map, etc...STOP blaming cell phones. If you are to ban cell phones, you should ban cd players (because you have to get the cd out and put it in, which most people do while driving), ban purses, ban food/beverage, ban EVERYTHING but a steering wheel, seats, gas pedal and brake. And if you want to continue to put blame somewhere, blame it on people's desire to look at other people of the opposite sex and make lude gestures, rather than paying attention to the road also. You cannot place blame on one thing (in this case cell phones are getting the brunt of it). Look at the big picture of things and let's all drive safely. We all have places to go, and the only way to get there most of the time is by vehicles. We all have loved ones out there, keep the mindset that you never know what the other drivers out there are doing...you do your part...DRIVE SAFELY, LEARN THE ROAD RULES!
I'm amazed more at KMOV's response to tape. Why sensationalize something so sad more than it's already been? Of course he's admitting to being responsible, he was the driver of the truck, he never disputed or tried to hide that. What would you have expected him to say?
I really feel sorry for the truck driver. He has to live the rest of his life knowing what he has done. We have all made mistakes, near misses, etc, while driving ... most of us are fortunate and have not suffered the horrific results of his. I cannot begin to imagine the pain in his soul.
truck' should have seperate lanes than car's
It's a sad situation for all involved. It was an accident, but probably one that could have been prevented if only people would leave their cell phones alone while driving and keep their eyes and attention on the road. Innocent people were hurt and died because of this. I can imagine how the truck driver feels. Intentionally, I don't think he meant any harm and probably has a lot of regrets and remorse over this whole ordeal. Slow down, pay attention, and leave the cell phones alone. It only takes a second, this is proof. Don't think it can't happen to you.
Cell phones should be banned while driving, but it's gonna be very hard to enforce this, especially with 18-wheelers since it's hard to see in the cab.
For all those that hope someone ends up in jail that is not justice and in America you are innocent until proving guilty. Well with all of you thinking like that it's just crazy. Why the designers of the highway are not in jail they gave the bad design that could possibly be a factor in this situation. If everytime you speed you went to jail how would you feel everyone who has a car has went over the speed limit if nothing but 5 mph over does that mean you should go to jail also. any automobile can do damage going at the right speed. After investogating the situation if the said driver is guilty then give him his time and if not everyone should be more concerned about those hurt and not putting one person down. We are not the judge God is, so let him judge and we do the best we can to help our fellow people in their time of need. God bless those who lost love ones and those that were injuried. Let's come together and pray for everyone. And get MODOT to do a better job at the design of these highways. And conduct the improvements in a more safe manner.
