(KMOV) -- Once again, the city of Black Jack is telling a family they’re not welcome. 

A family of five just bought a house in Black Jack, but the North St. Louis County city said they don't meet its definition of a family.

Toi Pruitt and Joe Pulliam just bought a 1900 sq ft house.

They planned to move in with Toi's three children over the weekend, but on Friday the city refused to issue them an occupancy permit because they don't meet the city's definition of a family.

Just last year Black Jack had to revise its definition of a family after Fondray Loving, Olivia Shelltrack and their children filed a federal lawsuit because they were barred from living together.

But even with the revision, this new family can't legally live here because none of the kids are related to Pulliam.

Ultimately, this dispute seems headed to court.

Tuesday afternoon a representative of the federal housing agency that took on the city two years ago told News 4 he's interested in the new family's case and Black Jack's city attorney indicated the city has no qualms about fighting the family in court.
